There must be something in the premier leagues guidelines or membership for this type of thing. It’s a massive breach of competition law. Their has possibly been commercial negotiations already happening behind the scenes (with the 12 ESL clubs) which have potentially had a negative impact on European clubs finances. Teams may have already been adversely affected by this. Financially.
