    From what I can see, this arbitration is purely about whether PIF are a director, or KSA. Once that's established, they will then separately run the test again.

    From what's been said here, KSA can't be a director. So PL are trying to say KSA are a director, which excludes them from owning the club, whereas NUFC are saying PIF are the director as a separate company/entity and should be treated as such. Hence the "separation".

    I can't see how. The PL are trying to say that PIF aren't a director, but KSA is. NUFC are saying PIF is acting on its' own. Shaheed is there to explain Saudi law. Nick's there to argue the stupidity of the PL's assertion.

    Reading further, it seems that the PL claim they couldn't even apply the test because they couldn't get past section A (who is a director and who has control). Section F - which covers whether the director passes or fails - hasn't even been applied yet. NUFC claim everything in the test, including Section F, was reviewed during the PL faffing and delaying, but this judge has backed the PL's stance that they didn't even look further than Section A. That sounds like utter bullshit, but backs up Staveley's claim that the PL were stalling and stalling. The influence of BeIN has already been established, so I've no idea how the judge reached the conclusion they have.

    That's law for you.

    PL are trying to get KSA to be a director so they can fail due to breach of company law.

    PL Section F.1.6. in the reasonable opinion of the Board, he has engaged in conduct outside the United Kingdom that would constitute an offence of the sort described in Rules F.1.5.2 or F.1.5.3, if such conduct had taken place in the United Kingdom, whether or not such conduct resulted in a Conviction;

    F.1.4. he becomes prohibited by law from being a director (including without limitation as a result of being subject to a disqualification order as a director under the Company Directors Disqualification Act 1986 (as amended or any equivalent provisions in any jurisdiction which has a substantially similar effect) (“the CDDA”), or being subject to the terms of an undertaking given to the Secretary of State under the CDDA unless a court of competent jurisdiction makes an order under the CDDA permitting an appointment as a Director);


    So if it's KSA, they fail on both counts due to human rights/piracy and not actually being a director. It's a really easy fail, in fact.

    If it's PIF, they do not fail on any count.

    Hence the importance of this arbitration.
