Arbitration is takeover related. Compensation is not the aim. Ashley is trying to sell the club, has a willing buyer and the issues relating to piracy are now resolved.
If piracy is resolved and the Premier League never formally rejected anything, can't they just resubmit the bid, answer the questions openly and takeover the club?
They are free to do so. The issue is the degree of separation of PIF. That is the issue for arbitration. The PL are asking for proof. PIF provided proof from the Saudi superior court, the highest court in their country. The PL wanted more. Arbitration will give a legal ruling on that which is binding. If they say 'yes the wealth fund is separate from the state' the takeover happens. The consortium will re-submit the bid and only the named directors of PIF, along with Staveley and Reubens can be considered. It's fair to say that objections from BEin are now removed. Legal action for piracy is ending.
So they need to hurry the quack up and get the arbitration out of the way. It’s not like it appears complex anymore either. Your making it sound cut and blow dry so why isn’t it just a quick one rather than quacking about.
That is just my guess. I suspect the degree of separation is complex. Once things like shadow directors and wealth funds are introduced the law becomes very complex.

De Marco and Fatima are literally the best in their respective fields. They will win this one and the takeover will go through. I think Ashley is hoping we stay up this season so thst the club can be sold in the summer.
Apart from anything else the premier league has aimed at delay from day 1 and they're fully aware pif won't go ahead on February due to the club looking like it might be relegated, so they'll delay and delay and delay and until the transfer window closes and probably in the summer too if they resubmit

Rule x.26 of the PL handbook 2020/1. Remedies that the arbitrator can grant. A sum of money is interesting. I somehow doubt that they have the jurisdiction to award compensation of £350 million, given that level of compensation is reserved for the High Court and above. Applying x26.2 they would likely rule that they cannot hear a claim for compensation at a level that Mike Ashley would claim. So it cannot possibly be for that. Rules x.26.1, 26.3, 26.6, 26.7 seem the most likely to apply. A determination of a legal question or question of fact namely the status of PIF and the PL's conduct in applying the ODT. Find in favour of NUFC then correct application of the test and specific performance of the contract of sale are the likely outcomes. Remedies are strict as per the handbook.

And you know what that means. We are so close and yet so far. SB has the chance to leave his ever lasting legacy as the manager who sent us to our wildest dreams or our worst nightmare.

I was thinking about his “remit” and what his objective is this season. Whether we like it or not he’s been told keep us in the PL. If he had just come out with that at the start of the season instead of all the crap about progress and top 10 then he wouldn’t be under the pressure. And the pressure is mounting on the club (not necessarily him) as now even his close mates(pundits) are ratting him out. But if his own boss has said to him “remember your objective” he will just stick at it. His “challenge” is to keep us up to keep the takeover on.
