    Toby said I insulted the French but can't find an example.
    Ciaran said the GFA mentions the European courts but he can't find a mention.

    Consequently, while the case may be made that Brexit has sated the appetite of Euro-sceptics to the extent that repeal of the HRA and withdrawal from the ECHR is no longer on the cards, the continued attacks on the HRA and ECHR following Brexit would suggest that this may not be the case. Were such a development to arise, this would be a flagrant breach of the GFA.

    Firstly, I readily admit to posting from a position of almost total ignorance on this, so could be miles off the mark, but just based on what you've posted there, doesn't that suggest that the terms of the ECHR has been adopted into UK/Irish Law in the form of the Charter of Rights, so they're the same as, but separate to the provisions of the ECHR?

    That being the case, it's a non-argument, as it exists either way.

    You don't seem to realise it's a new Human Rights Commission for Northern Ireland.

    Point being this worked while the UK remained within the EU framework, the UK are in the process of leaving said framework specifically to extract herself from things like the ECHR. How then does their obligation to the GFA in regard to this specific issue continue to be viable considering Ireland is an EU country?

    They withdraw from the ECHR yet adhere to it at the same time to allow them to uphold their obligations under the terms of the GFA. It can only be one, they're mutually exclusive.

    As I said, I'm pretty ignorant on these things, but the information you posted seems pretty clear that the terms of that are enshrined in UK and Irish Law, and stand independent of the ECHR even while we are/were in the EU. It doesn't look as if it makes any difference as it's the Charter of Rights that has precedence. The comments on the ECHR even says the NI Bill of Rights has been produced to represent supplements of it.

    The ECHR are not part of the EU.
    The GFA is nothing to do with the ECHR other than having a separate commission based on the ECHR at the time of setting up.

    Ok you're right and I'm wrong, it doesn't really make any difference now considering the border went up the irish sea, think I remember some on here proclaiming that wouldn't happen.
