Membership direct debit

    I have cancelled and told the club I will pay two months.
    At the same rate they are charging everyone else for the next two months.
    I might have a look at the contract as I suspect they may be on dodgy ground treating me differently.
    I bet this sort of thing is untested, legally.

    They can sue me for the cash as I won’t pay if no one else is.

    You signed up to paying a monthly amount, with two months of those payments to be made if you cancelled.

    Legally, you haven't a leg to stand on, they almost certainly will take action if you just stop paying and unless you want the bill to double, you'll pay it.

    Fair play, and as you say each to their own, however if my loved one cheated and lied to me on a continuous basis they wouldn’t be my loved one for very long.

    Reasons for keeping my membership;
    1, them c**ts ain’t driving me out (stubborn £@@ker)
    2, can’t be arsed to write the letter.
    3, if I did it’d be libellous, hot water!
    4, quite like the folk who attend near me.
    5, shopping on a Saturday isn’t my idea of fun, but there again...
    6, which should be higher, enjoy the Odd pint with den and askew occasionally before the game. ( when I say odd it’s cos there’s 3 in the round!!! So it’s always an odd number)
    Guess there’s more but it’s bedtime.

    respect everyone’s decisions/ principles when it comes to those two odious (@@ts, do what’s right for yourselves :emoticon-0148-yes:

    I suspect that is a blind opinion rather than an opinion based on scrutiny of the contract?

    I didn’t present my opinion as fact, but your post is unequivocal.
    If I can source the t and c I will see what it actually says.

    Edit: on reading just the opening pages I see this:

    Monthly Fee” the monthly fee (inclusive of VAT) payable each month in respect of each Membership included in the Membership Agreement, such fee to be calculated on the basis set out in the Brochure and these Conditions and stated in the Application Confirmation or be as otherwise agreed by you from time to time during the period of your Membership Agreement.”

    it’s quite clear that the fee is zero at the moment as agreed during my membership period.

    I need to work out their rights to suspend the agreement unilaterally. If not catered for explicitly then this paragraph just tells my my member fee is zero (as opposed to the whole agreement in limbo).

    Also it refers to 4.7 in relation to early termination fees.

    Early Termination Fee shall be an amount equivalent to the total monthly fees that would have been payable by the Member in respect of that Additional Member from the date of termination up until the expiry of that Additional Member’s Minimum Period had such termination not occurred.



    Quite clear I may have a leg to stand on.
    What I would have paid is zero in that period. It says clearly in the time the notice applies to.
    I’m happy to argue that one!!
    When you said I don’t have a leg to stand on legally which bit of the t and c were you pointing to??

    Early Termination Fee” means the fee payable by the Member to the Club if the Membership Agreement is terminated, or if any Additional Member is removed from the Membership Agreement, during any applicable Minimum Period as determined in accordance with condition 4.7.

    Seems simple??

    I'm in agreement with you. I need to read properly but as far as I'm concerned we need to give two months notice, for those two months we should be treated as any other member. So if they don't take payments from others they shouldn't from us.

    I'm cancelling because I don't expect to feel safe to go back into crowds in October. I'm fully prepared to argue with them if they try to charge me. I quite enjoy it really.

    It’s more clear than I had hoped.
    In fact it’s specific you pay what you would have otherwise paid in the two months had you not cancelled.

    it’s absolute. Not even an argument
    Legs intact.
    Danger of taking legal opinion from forums! People will make assumptions. I have quoted the contract and I am more than legally qualified to assert there is a clear direction.

    if anyone has come back from the club please quote the above paragraphs and ask where they source their claim money is owed, backed by the source material in the contract (just google Hull City membership terms and conditions for your copy).

    Incidentally, if anyone is thinking of cancelling, then cancel today or tomorrow and you'll be liable for the August & September payments, but any later than that and you'll be liable for August, September and October, as you need to give a full two months notice.

    And that's good advice above, definitely don't take your legal advice from a football forum, you could end up well out of pocket.

    We said very different things.
    The key is to make it clear if it’s just an opinion, or if it’s based on fact rather than an educated guess.


    I speculated, Making clear I was assuming there may be a get out, then researched.
    Took me a bit as reading the t and c on a phone wasn’t ideal!

    The distinguishing factor then is that you are not taking my advice off a forum, you are taking it off the contract details posted on a forum!

    <laugh> Good luck to anyone who wants to try their luck with this, I'd be more than happy to see them successful, I just don't think they will be (not unless the club decide not to chase people who stop paying, which seems unlikely).

    It’s simple.

    if the fees revert to £ in your notice period you pay.
    No ambiguity there at all. The club have quoted my payment dates for my 2 months. If the dates are in a zero pay month I owe zero.

    I’d like to see them find another clause in there. I will admit I have not read every word in the t and c but the sections that apply are very difficult to construe differently given the bit I have made bold. I have asked the club to comment on the above if they disagree.
    I’ll post any comment.

    (in addition it seems the club can’t terminate or suspend the contract without specified reasons (S9), covid not being a reason, so the current zero pay months are legally membership months they charge at zero and NOT suspended membership periods that don’t count to the notice period. This adds more legal weight to a clear position in the rest of the document)

    Sadly, I am in agreement. Tolstoy wrote shorter novels than the membership contract.
