    Not sure how Saudi lawyers not taking on the case can be shown that Saudi State protected the piracy as opposed to Saudi CPS not prosecuting which possibly could be.

    But now the Arabsat platform has ceased broadcasting BeoutQ channels. So Saudi’s have now started to do something.

    No. As the PL and other TV rights holders who were having their product pirated by BeoutQ sought to bring copyright infringement proceedings against them in Saudi which is a civil not a criminal matter. The PL alone spoke to 9 different legal firms in Saudi regarding taking the case and were either refused, or they accepted the case and later recused themselves. Or in other words, the Saudis weren’t having any of it.

    The issue here was patently political, and was the Saudis sticking one in the Qataris ribs by allowing products they’d paid a fortune for the rights for to be broadcast via a Saudi satellite free to air. Hardly needs Poirot on the case like.

    I am referring the findings of the WTO report which will not impact the decision of the PL. The PL enforcement of their own IP rights is a separate matter outside of the scope of TRIPS.

    The Saudis had knowledge that piracy was going on, did not take steps to stop it and failed to prosecute those responsible under their criminal law. That is the finding of the WTO report.

    Civil action is a different matter. The PL may have been thwarted, but the jist of the WTO report concerns the dispute between Qatar and Saudi. They were justified in denying BEin access to the Saudi legal system under TRIPS. Clearly, denying the PL access is wrong, but that decision is not subject to the WTO conclusion. It is for the to pursue separately and resolve with the Saudi's.

    The Saudis have clearly breached international trade law and have been advised to remedy this immediately.

    In terms of Newcastle the WTO report is just one part of the jigsaw though mate.

    The PL plus UEFA, FIFA, The Bundesliga, Série A & La Liga knew well that they were being thwarted by the Saudis in their attempts to bring BeoutQ / Arabsat to court regarding copyright infringement, as they issued a joint statement at the time expressing their frustrations over it.

    The WTO ruling just adds more weight to their view that the Saudis were complicit due to their failure to act for 3 years.

    The bottom line, is that the Saudis were playing politics with other people’s copyrighted products as it suited their own ends. Hardly a good look if you’re then trying to buy into one of the leagues who’s product you allowed to be stolen.

    This is a very good point. But a solution is needed. To the piracy. The the takeover and to beins loss of income/access.

    The PL are very aware of what is at stake here. They stand to lose most if they don’t play their cards right.

    BeIN have already stated they’ll bid less for the next contract. If Saudi’s are in then PL are likely to make the same as this time if not better. If Saudi’s are out, do you honestly think the tv piracy will stop? If it hasn’t then BeIN win and pay less. PL get less.
