No evidence of failure. The WTO report is a confidential document until released publically. If it has been leaked then use of it in the public domain is breach of confidence. In other words, if the PL were to make a decision to fail using that report prior to official publication they would be sued.

Who would you rather own the club - someone like Vichai Srivaddhanaprabha, a group like Fenway Sports or Saudi? I'm as pissed at this whole sorry affair as anyone, but Ashley seems certain to leave and Saudi isn't the only option.
Reasonable doubt only applies to criminal law. Balance of probabilities applies. If they refer to the WTO report, by quoting evidence of links from it they cannot use it until it is public. They are not a party to the dispute as the WTO deal with trade disputes between states, not private companies. The PL has to give a written decision, provide disclosure of evidence considered and give a right to appeal. Use of a leaked confidential document would be frowned upon.
Where the PL not given the report by WTO for them to take into consideration? They would stipulate that no comment can be made until the document is in the public domain which of reports are correct is middle of June.
