I'm so upset I didn't go on twitter at 10 pm last night. Can't believe I missed this piece of stunning news.
Steve Wraith came off twitter for a bit because he was being inundated with private messages about the takeover by trolls. Hurling abuse was the upshot. Has absolutely nothing whatsoever to do with knowledge of any takeover collapse. The PL hasn't failed the takeover because they have no legal basis to do so. Again, due process applies. You have to be CONVICTED' of copyright infringement under the Copyright Designs and Patents Act 1988 or an analogous foreign provision in a competent court. Allegations do not satisfy the legal test set out in Premier League Rule F 1.5.3. If the PL misapplied this then they would face sanctions from Court for Arbitration of Sport and no doubt find themselves in front of a High Court judge in this country. There is no news because we are in the middle of a global pandemic, with chronic uncertainty and the PL are focused on restarting the season. That takes resources. Takeovers are given low priority. Timescales are irrelevant at the moment and there is no adverse inference to be made.
after reading through that I guess you are correct Rule F. 1.6 https://books.google.co.uk/books?id...AEwDHoECAgQAQ#v=onepage&q=rule F. 1.6&f=false
Rule 1.6 is a catch all and is subject to legal challenge. It allows the PL to convict individuals without due process. You can bet if they invoked that rule they would end up in Court.
Rule 1.6 is a catch all and is subject to legal challenge. It allows the PL to 'convict' individuals without due process. You can bet if they invoked that rule they would end up in Court.
It’s their rule and gives them discretion to act as they see fit. Whether they’d choose to use it, and having done so, on what grounds that could be legally challenged, are separate issues. I was merely pointing out that your assertion was wrong, as it was.
Although what you say sounds very plausible. Surely the allegations even though unproven derail the takeover. If they approve it and then it is proven that the allegations where indeed proved what happens then? If anything the covid thing would mean that normal day to day work at the FA has stopped and that they would have additional resources available to sort the tests. I personally think it is to do with covid but more than likely it’s pif dragging their heals for whatever reason. Ashley’s onto a winner with this one so for once he cannot control the deal and force it through. He dare not say anything because he wants out.
Indeed. I stand corrected on that one. Legally though, they may open a can of worms and probably know it. Needless to say as well the PL will be mindful of Saudi's and their considerable wealth and most importantly, the possibility of diplomatic embarrassment. A private body ruling the wealth fund of one of our closest allies and trading partners as unfit.
It’d be a bold call to use it on the basis of human rights abuses, and I doubt they will. It’d be far more likely that they’d use it to protect the value of their asset imo i.e. the TV rights. So it depends what the strength of this latest evidence provided to them is, and who’s brought it to their attention.
People are clinging on to hope, but the same people saying there's no time to this are the people who were picking the next ****ing day ad there predictions a month ago. This proves that these people are moving the goalposts in order to suit their views. it's off
I agree.... it's their product being stolen and their customers complaining. I think it's a case of people taking up the position that suits their emotional decision on this one, but in reality nobody knows what the decision is likely to be.
