Tom Hicks and George Gillett will be represented in court against New England Sports Ventures, now the Fenway Sports Group, RBS and former Anfield chairman Martin Broughton. The two-day case brought by former main creditor RBS is due to start today and is expected to be highly technical. The hearing will be before Mr Justice Floyd, who previously ruled that a ã300m deal with NESV could go ahead. After losing control of the club, Hicks claimed NESVââ¬â¢s takeover was an ââ¬Åepic swindleââ¬Â and said he was stunned that it had been allowed to go ahead. Hicks and Gillett have never accepted the sale, that saw them lose ã140m. RBS will ask for an ââ¬Åanti-suitââ¬Â injunction to be upheld. It was taken out when Hicks launched a ã1.6bn lawsuit in Dallas trying to halt the sale of the club in October. The Americans will ask for the injunction to be overturned. The suit had overturned a restraining order in Texas where Hicks and Gillett lodged the damages claim against the English directors at Anfield ââ¬â along with lenders Royal Bank of Scotland and successful Liverpool bidders NESV ââ¬â claiming they were undervaluing the price of the club and disregarding other, allegedly higher, offers. In December, when the Americans launched the fresh court challenge, Keith Oliver, from London-based solicitors Peters and Peters, who are acting for Hicks and Gillett, said: ââ¬ÅIt is hoped that the hearing will enable the dispute between the various parties to be unravelled and the way forward to be determined. They (Hicks and Gillett) feel very wronged by the process and will consider their options.ââ¬Â Mr Broughton is understood to be unconcerned by the threat from Hicks and Gillett. The two men lost control of the club in October following a trans-Atlantic legal tussle that saw courtroom drama in London and in Dallas. The encounter concluded with John Henry succeeding in his bid to buy the club. At the time, Hicks said: ââ¬Å(Iââ¬â¢m) Shocked. Devastated. Frustrated. Iââ¬â¢m very disappointed. Itââ¬â¢s hurt my family tremendously. This is a very valuable asset that was swindled away from me in an epic swindle.ââ¬Â
