You can’t. You can only legally take down the branches that are overhanging your boundary, and then you’re supposed to offer the wood back to the person who owns the actual tree!
I can say the large branch that hangs over the garden is a risk. That's all I wanted shut of anyway, the rest I want to stay. It's over the van in winter so it drops leaves and gunk all over it, plus the birds sit on the branch and **** all over it. The van that is, not the branch itself.
I think you need consent to work on a tree with a TPO, even if its branches are overhanging into your garden. Where we live there are hundreds of TPOs and the council are very nazi like in controlling them.
Then you have to get the owner of it to sort it. You can’t chop down trees that other people own bro. There’s a massive old silver birch that’s on my neighbours land but overhangs part of mine. The ****ing thing is a pain in the arse and has plenty of dead wood on it that drops on my side. I had to get a tree surgeon in with rope and tackle to climb the ****er and cut off the branches that were causing the issue, I had to pay for it, then offer him back the branches ffs! He refused in fairness, so at least I got some firewood for my 400 notes.
We had someone look at it last year. Think we're meant to phone back to see if it was ok to take that branch down. They certainly haven't phoned us anyway. Will have to follow it up but be hard getting anyone here at the moment.
