Hope you read the edit. Language is a factor though in these type of cases, I mean assault of any kind here. Again I could be wrong but for a 16 year old, on his own to attack a bloke that size?? If and I mean IF the scenario was Gareth trying it on with the kid then it's not illegal (if he touched him etc I doubt a 16 year old would be looking to take the legal route). If the kid then punched out the it's still the kids fault and assault If that makes sense.
