It wasn't due to leaving the country mate, it was down to FIFA having about 5,000 levels of appeal (all of which Mutu lost) which made the thing drag on for years.
I`d not expect much to happen immediately. Based on what the club statement says SAFC are saying he has broken his contract in a fundamental way (that`s what a repudiatory breach of contract is - the equivalent of in a more common scenario is an employer failing to pay its employees - that failure is a repudiatory breach of contract). The club has, rather than trying to make him remedy that breach, accepted it as sufficient to terminate the contract. The acceptance of a repudiatory breach of an employment contract is where the idea of "constructive dismissal" comes from. Generally run on the basis of making life at work intolerable...a breach of the obligation regarding trust and confidence owed by an employer to its employees... I`d guess that the basis of the deal whereby he was given the month off to sort himself out a club had clauses in it saying "you`ll need to be fit if you return" and "you`ve got until [a set date] to get back". We know he breached the date requirement and I guess the club have the data from the medical/fitness test to show he`s out of shape. I`d guess that if you add those to the statement of "I`m never wearing a Sunderland shirt again" you`ve got a half decent shout at the argument the club is going to run. Whether we sue him for the "lost value" I think is much more difficult - how do you value a footballer - the ultimate test is what someone is prepared to pay - the fact that we paid an over-inflated price is neither here nor there. That he`d been involved in 2 relegations (or was it 1) and was a League 1 standard player (because that was where he would have played for us) must have a significant impact on his true value. I`d guess there will be an amount of emails with his agent that would ultimately be disclosed to see what(if anything) other clubs have offered for him. From an SAFC perspective I`d not rush to sue him as I don`t see how we establish the amount of the loss. We will have 6 years to bring a claim though - no need to rush! That said if he sues (SAFC had no grounds to terminate my contract - I`m going to sue for lost wages) then I can very much see us using the valuation issue as a counterclaim in those proceedings (on a **** it - if we`re in court anyway let`s throw everything we`ve got at him - kind of basis). All of the above ignores any special rules in respect of the FA/FIFA/CAS etc... I`m sure that the club will have decent lawyers acting for them but equally that he`ll be able to afford some of his own...If Stewy D is reading this I`ll gladly take the job on (although I know **** all about sports law!).
Notice is the important word. He ain't sacked yet but should be in due course. There's protocol to follow like there is with everything. Not as simple ripping up his contract and saying piss off. His registration is an issue and it's outside a registration period. App in to Fifa, who govern all player registration, and they should release him with no quarrels, just have to wait a bit. Can't see Fifa blocking it as both parties want this. The civil matter of recouping some losses could take years though. Hope Fifa can sort this quickly as we really don't want this lingering.
