    If they were actually AWOL we probably could sack em, unfortunately they're not. Club has stated we're happy for any want away players to stay way I assume to prevent a toxic atmosphere.

    So if they turn up after the euro/loan window closes we have to start paying them again or let them leave on a free if they wish?

    We've never stopped paying them mate. Not privy to the small print of the contract but as said, if we could release him, we still owe **** loads to their previous teams so it's in our best to maybe wait till Jan, Depends on the maths but my guess would be holding on to them till the end of the Jan window at least to try and get some fees would be the best way to go. They've had wage cuts after all.

    So have we allowed them the potential to go travelling around Europe on their jollybobs, being rejected by god knows who and paid them for the privilege? Last thing I knew was that they didnt turn up for training nearly 2 months ago and we were starting disciplinary action against them which I assumed were fines. Heard nowt else since. I only raised the OP because somebody on Roker Report was wondering why they hadnt been sacked yet, so he's obviously assumed the same as me.

    If we don't pay them we're in breach of contract and they can apply to fifa to be released. If they haven't turned up yet we can apply already to fifa to have them released. Given we haven't done that I can only assume we still owe **** loads on them so we're holding out fo fees in the coming windows.

    So despite them not turning up for training we still have to pay them and not fine them? Or are we basically paying them to stop away and look for new clubs?

    Not sure about that. Where did you get that from?

    We had to keep paying Rodwell cos he did the bare minimum not to be in breach of his contract.

    These 2 twats are in breach of their contract, so we can fine them their wages. We could release them from their contracts, but we wouldn't get any transfer fees for them so we are just fining them instead.

    If they turn up at the end of the window and started to do the bare minimum , then we would be obliged to pay them.

    Happy to be corrected if wrong, but that's my understanding of it.

    I heard that they simply didn't return from the summer break, unlike Oviedo, for example, who was at the WC and had an extension. Might be wrong, but that was why I thought they weren't being paid at the time. Things might have changed, but I suspect Bri is right about holding on for the fees. Makes no sense to let them go for nothing if we can get some sort of fees in, although the idea of suing them for the loss on what we paid through their hold-out is certainly appealing.

    It's contract law not employment law, they're not paid by conventional methods. We've already fined them but it's max 2 weeks wages per offence. Whether they get paid or not doesn't concern me, the saving the club money is the priority and if that means paying them while we chase the fees we want so be it. Impossible to say without knowing the maths but I'm pretty sure we could dump them both now and we haven't so we must owe **** loads on them still.

    Nobody gets released without FIFA permission that's just a matter of fact. If either party apply to have their contracts ripped up Fifa will look into it, if on investigation the other party has failed to uphold their part of the contract, Fifa will award to the complainant unless it's contested(then it gets messy), but if they haven't turned up and we're not paying them and fifa are dragged into it, they're sure to release them and where does that leave us with debts on the players and no fee incoming on them to help pay it? We're not obliged to pay them, but if they take it to FIFA they'll be released and that's no good for us is it?

    We can only fine max two weeks per offence. PFA rules. They'd have to come back and go awol again to fine them again.

    Two wrongs don't make a right in contract law. If we want a leg to stand on (and eventually get a fee out for them) We need to toe the line on our obligations. As said, all depends how much we need that cash as I'm pretty sure we could dump them now.

    They know the crack at the club, how ever they're handling it, we as fans just don't know the best way without seeing the related finances init.

    The release of players in contract i read into in quite some depth around the time of the Alverez shiz when he left us for Lazio. It's still fresh, plenty of time to forget it <laugh>

    I'd love to try that with my boss. 'i think I'm better than this place, and even though I have contributed to the near destruction of your business whilst happily taking over inflated wages, im gonna spend the next few months on holiday whilst my mam spends time looking for a better job for me, obviously whilst still getting paid by your good self.'
