I'm guessing he will look at the original arresting charge of Breach of the Peace, then ask himself "if there was contempt of court, why didn't the Police charge him with contempt in the first place". They then investigate this and then charged him with Contempt of court. As i explained with the example of The Yorkshire Ripper. The police arrested him for having false number plates but charged him with multiple murders. I really don't get why this is such a difficult concept for you to understand? Are you suggesting police should only ever be allowed to arrest someone and charge them only for that offense regardless of any subsequent evidence?

I think on pure interpretation contempt of court of law he is guilty. There could be an interpretation of broadcast that they could argue but I think this would be squashed based on the fact he was warned at his previous sentencing on what would happen if he did it again. However with out the Judge's sentencing notes being published it's difficult to say that 100% yet. As for technicalities/procedures there has been a lot of claims by 'friends of our Tommy' but little of what I 'd call actual evidence but if these are proved to be correct and are enough to be grounds for appeal/retrial then I'll happily accept the result and say he should be released. But good luck getting his supporters to accept the result.They'll be getting their framework for the result now. If they win they were right if he loses they were right the system were corrupt. It's a playbook that you can currently find being wheeled out on brexit.

Sometimes twats commit contempt of court at the risk of mistrials of ****philes going free and when they are on suspended sentence and commit it again then they deserve to get jail time. As a general rule of thumb if she supports something I'm generally against it

I don't normally follow this thread, but mistakenly found myself on it & was intrigued as to why Stephen Yaxley-Lennon was being discussed on the Brexit thread. Tried, but eventually couldn't be bothered wading through it all, but discovered on here that Mr Yaxley-Lennon had appealed. I skimmed a few other posts & had a wee chuckle to myself. As ever, some facts & a lot of fiction. A lot. Few things to mention: 1. Mr Yaxley-Lennon's legal team is NOT appealing his admission of guilt. They accept that he is a convicted criminal. Just to be clear, that means he's GUILTY AS CHARGED. 2. Mr Yaxley-Lennon's legal team is simply appealing sentence, thinking it too severe for the poor wee soul. Apparently his life is in danger in prison, so that is one of the main planks of his appeal. It will fail, as it's never worked for underworld gang members who go are sentenced to do time in the jug alongside rival gang members. Several murders & countless serious assaults in the jug have not altered the Judiciary's view on this. Ever. Nor will it for obvious reasons to those that can reason. 3. As far as I'm aware, Contempt of Court is outwith the jurisdiction of the police. It is only a matter for the Judiciary to consider. Put simply, if guilty, you have not complied with the general rules of the Judicial system, or a direction from the Judiciary, so only they can find you in contempt. The police are asked to bring the contemnor before the Judge. 4. I may be mistaken about this, but I believe that Mr Yaxley-Lennon was never tried for the Breach of the Peace he was arrested for. Perhaps they're saving that for the day he gets released? In case you're wondering why I'm addressing TR as Stephen Yaxley-Lennon, it's quite simple - it's his (rather upper class-sounding) legal name, and this is the law we're talking about, not his usual nefarious activities.
