Then they’ve got nowhere to go with it from a discip perspective. They could in theory try for the breach of contract angle, but any solicitor worth his salt will advise an employer against that route. If they’ve issued the final warning in writing simply appeal it and see what happens mate.

When they schedule the appeal hearing they should invite you in writing and make mention of the fact that you can be accompanied by a trade union rep. During the hearing, to do it by the book, they should listen to your evidence that disputes the warning and then adjourn the meeting while they consider their decision. If they don’t follow that protocol then you can probably rightly claim their decision to refuse your appeal was preordained if this ends up in court one day.....

Yes I have been told that within 5 working days , I should get an appeal date and that I can have a Friend or Union rep with me .

My mate said when I rang the woman ( HR ) If she says " Please send me an e-mail with your reasons why you want to appeal " . Say I will send you an e-mail confirming my decision to appeal , but the reasons for the appeal will be disclosed at the hearing .

Sure enough , she asked for the reasons in an e-mail ( She was not amused with my response ) …….

    Anyway all .

Time for Dinner and a walk and bed .

    " Chat " later :)

    PS

Thanks for all your advice / Input . Honestly appreciated

Off to a big food and music festival today with my business. Thankfully it’s local so I can still be home around 8pm for some beers and chill

The whole fam just went to some dog show thing in Bristol. Having a nice cup of tea, followed by breakfast and then wash the car down.

Golf all afternoon, no rush to get back so a pint on the balcony after. Plus fours and tweed at the ready.

Was supposed to be going with half a dozen other couples this weekend to Ascot for todays racing.

Coz of my problem that's all been cancelled but we're all going to spend the afternoon together at our village pub picnicking and gambling like the real thing.

    Great bunch of mates!!!

Got a couple of the kids coming down after lunch, off to a mates BBQ this aft, then taking the youngest out to celebrate his Uni results. Hopefully the sun will come out a bit cloudy at the minute.

Nice one mate. It's always good to celebrate success in the family. It's roasting already down here.
