    If you reported us for an illegal approach for him last year, then what happened with that complaint?

    Surely if you had water tight evidence then the FA or PL would have found in your favour and given us a sanction?

    I don’t get how you can subsequently sack him and then 6 months later claim that we have no right to employ him, it makes no sense.

    As for the contract he supposedly has from you before he left Hull City, your club is claiming that he had a clause in his Hull City deal that allowed him to talk to you - given that he and thus Everton obviously know that, if it was contractual, then we’d have not brought it up as a counter.

    The entire ‘tapping up’ in football charade is just that, a complete charade. Every managerial appt and player move involves a degree of it, and to deny otherwise is naive.

    This case sounds like you now regret not taking Moshiri up on his £15m offer last year to me, and want to somehow wind the clock back. You sacked him, so you have no contractual hold over him.

    If you want him then I, for one, have no problems with that. He is a free agent now. Unfortunately the interest Everton showed turned his head a little, and he started to believe his own hype. We actually did him a great favour by sacking him because 2 relegations in 2 years with different clubs would have looked very bad on his CV. - he should be thankfull to us. We are not talking about a 'Klopp' or a 'Guardiola' here - he is a largely unproved manager at the highest level. He started well with us, but then so have a lot of others. He started well at Hull, but lost the thread by the end. Basing his managerial reputation upon his time at Sporting Lisbon is a waste of time because there are only really 3 teams in their league and so it would be difficult not to win something there. I am not bringing him down here, just being realistic - he still has to prove his spurs.

    I seem to remember that Liverpool have beaten City 3 times this year <laugh> Also Guardiola once said that he thought Klopp was the best manager in the World. I respect Guardiola a great deal, and he seems a nice guy - also he has based everything he knows on Johann Cruyff's influence, and you can't get better than that. Klopp is the best manager for attacking football although sometimes he lacks a plan B. Also 'game management' is not his strong point - but who would want to watch Mourinho's teams every week. Actually Klopp was made for Man.Utd, but Liverpool got there first - I think that Sir Alex acknowledged this.

    Go back and look at the BBC news etc and yo will find Watford did complain about the approach. You would have to ask lawyers why it went no further at the time. I think we just registered a complaint.
    You have every right to employ him - if you pay the penalty for your illegal approach. You may not understand it but your Board did and already offered us an out of court settlement - you only do that if you are guilty.
    Hull are the ones saying our approach was legal so take that up with them if it floats your boat.
    We wanted Silva not £15m but as you effectively caused him to quit through failure to perform - taking us towards relegation in the process - we have a right to compensation as you destroyed the relationship Silva had with us. Look we are both not lawyers so let's leave it to them to sort it out. Seems clear to me and we will win.

    Leo I think that them employing him now and their settlement of any penalty for their actions then are 2 entirely different issues. He is now a free agent, and not under contract to us and can freely go wherever he wants.

    You are right Leo, we did lodge a complaint at the time, and the FA suggested that the two clubs should try and find an agreement that would be acceptable to both of them. There have been talks, which would explain the time lag, but it looks as if there is no agreement. It may be that the FA will still become involved.

    Correct. He is a free agent and if you read what I said it is that Everton are free to employ him. However they know that if he goes to them it strengthens our claim for compensation as they are seen to have directly benefitted. That is probably why they have not yet appointed him and why he is so worried he is trying to stir up false allegations. He too would almost certainly then lose any claim to compensation for breach of contract and probably open himself up to the same claim.

    We made a susbstantial offer and Watford declined it. We then moved on and employed Allardyce.

    Over 2 months later Watford sacked him after a poor run of results.

    Watford now claim that they still somehow have a right for compensation and are using the threat of legal action as their supposed lever. Everton would rather settle this matter amicably but there appears to be some really deluded views on employment law in Watford.

    How could Silva be sued for breach of contract when you sacked him due to poor results?

    If we employ him that’s got nothing to do with Watford, as he’s a free agent.

    Agree with you on many things, as you may know, but you must admit Everton's approach, as well as Silva's reaction to it, were a tad responsible for Watford's dip/total collapse in form?

    Ever been to an employment tribunal Tobes? If you had you would find that events of a year ago or more would be looked at in the context of what happened at that moment, and anything that happened after that would not come into it. Sorry but Everton created a situation at that point by offering to buy out the contract which was refused. That is where the dispute stands. We are talking only about that moment in time.

    His reaction when asked about it when we were reported to be interested was telling and it was obvious imo that he wanted the job. How that then impacted on your form post blocking the move is anyone’s guess. It’s easy to say the run of results was a direct result but he doesn’t cross the white line.

    Yes and I think you’ll find that events of year prior are only relevant if it directly leads to the dismissal being discussed at tribunal.

    You sacked him over 2 months after the approach, which you declined, as is your right, but you sacked him on performance issues and cited the approach as the catalyst, which is bonkers,from a legal perspective

    Given your form on treatment of managers in recent years I think you’re taking the piss tbh.

    He had signed a contract for a specific length of time. If he wished to break that contract he could only do so with agreement. That was not given. If the boot had been on the other foot and the club had made it difficult for him to do his job; that would have been constructive dismissal.

    I was replying to the comment by Tobes , that people that do not know much about our club think we sack our managers without good reason ,as im sure most people in Liverpool do not understand Everton and there thinking.

    Tobes neither you or I know exactly what was written into his contract, therefore we are both relying on what we read. I have read that after the initial approach by Everton they didn't take no for an answer and approached him or his agent directly on four occasions. That is totally wrong according to the FA rules. Was he being offered a lot more money? We do not know. If he was,and I say if, then he might have felt that he needed to push towards leaving. If that is the case then he and Everton were not acting in an ethical manner.
