Holgate and Firmino incident !

Remember this incident is essentially an employee grievance/disciplinary, a HR department in any decent sized company will have had training in how to handle investigations and have access to legal advice. The standard of evidence in these cases is balance of probability so in that sense it should have been easier to find Bobby guilty of the offence, Thinking about it now, if they believe the allegation was made in good faith yet that is not enough for the balance of probability then that for me leaves two options
A) They think Holgate has misheard what was said.
B) There is other evidence that points to the event not happening.

Otherwise, why not charge him with the offence? tw@ts

true. They said "insufficient" which suggests they do not have B) as if they could give us a transcript of every word then it would be categorically A)

IMO they have in effect said

C) We are not sure of everything said from video but the crowd around saying they didn't hear the alleged word/words and if we charge him we will have to admit in public how thin this is so lets just blacken his name a bit...

I think what you meant to say was there was no evidence to charge him. Just like a woman is pregnant or not pregnant. Wonder if Holgate will play the race card again as it got him out of trouble this time.

I did wonder about that at the time, is anybody claiming this?

Anyway he was found not guilty full stop.

 

Evans supporters offered a reward to anyone who came forward with evidence and someone did - think it may have been the hotel receptionist.
Having not heard all the evidence i cannot offer a view on the courts decision but am prepared to say the Evans support group basically hounded the female via social media rather than just supporting him.

Bobby should have feigned outrage and claim that's exactly what he heard Holgate say.

Well lets imagine we are on the disciplinary panel where Bobby has a grievance that his colleague Holgate is making a false accusation about him.
Evidence we have so far that it is a false accusation-
Nobody else hears it or anything like it despite plenty including ref being around.
Holgate is clearly angry having moments earlier physically assaulted Firmino..
Video evidence shows Firmino does not say anything that may be mistaken for "the word".
At no stage does Holgate admit the possibility that he might have misheard what was said.

Balance of probability?

 

It's actually supposed to be 'reasonable belief' in a workplace tribunal, and based upon that you'd have to say there's more reasonable belief that Holgate made it up than misheard anything.

 

Its a criminal offence. Pass it to the police then base your decisions on what the cps has to say. By all means anything below criminal offence can be investigated by employer.

 

Imagine if the situation had been in reverse, PJ would have found the Everton player guilty from minute one.

 

So Holgate made this up and it’s a criminal offence?
