HDMEditorJohn Meehan In sport tomorrow: An interesting new development in the #JimmyBullard saga amid more reports of clubs interested in him. #hcafc #HullCity Any idea what it is?
I am amazed he is appealing. Why bother? Does he think the Allams (who will hear the appeal) will turn round and say "OH Yes, we made a mistake and we now think you are a good employee". He has a simple choice to make. To accept what has been dealt to him or to sue for wrongful dismissal.
Probably the fact that were sh ite and the Pearson duo have finally seen sense and have forgiven him and asked him to reconsider his appeal. Back in the team on Saturday.
HDM have tweeted about 50 times in the last month that there will be news the next morning about transfers/Bullard/whatever and each time it's been bollocks.
He will probably appeal to the football league and get an independant review board, not directly to the Allams!
According to my Aunt Bee, Wolves are sniffing around Bullard....McCarthy must be a couple of slags short of a harem..
The appeal has to be carried out by the employer (but someone different to the person(s) who carried out the disciplinary). The Football league has no jurisdiction to determine an appeal over a dismissal of an employee. If he does appeal it would presumably only be to go through the motions before commencing Court proceedings.
The Club still holds his player registration. He'll need it to sign with another (Prem?) club before this window shuts. Will he go quietly, in order to get it? Or does he think winning an Unfair Dismissal case will be worth more money? (Don't forget - it's not about the money...It's about the football!)
I would think so. Blackburn interested as well as Wolves and QPR now.... http://www.skysports.com/story/0,,11676_7120063,00.html
If bullard wants his playing registration released then JB will have to sign a peace of paper which states that he will not contest his sacking. If Not, i guess the Allams will see him in court sometime in 2012. whats does JB do then ? no team - no wages and not much to do except fishing.
maybe there is more goin on than is being released ? surely that is the key to getting this matter concluded without a protracted on-going affair ? or simply that maybe JB has had a reality check ? i cannot see the Allams allowing there ace card to be given so easily ? CAN YOU OLM ?
I keep seeing people saying he won't be able to play for a club till January and that holding his registration will be a prevention to Bullard appealing. Is 4months without pay really going to effect him? Surely he will have cash in the bank and will get a decent signing on fee in jan to look forward to. If I was him I'd appeal. Not that I want him to but I can see why he would, he's not got anything to lose. Clubs will still sign him irrelevant of what happens with us.
He's probably got nothing to gain by appealing either. It's likely that the Allams will decide any appeal and there is no chance they would allow his appeal and reverse the decision to sack him. He's more likely to pursue a claim for breach of contract in the High Court where he could claim the money he would have earned if he hadn't have been sacked, plus his costs. He's unlikely to bring a claim for unfair dismissal in the employment tribunal as the maximum he would get would be in the region of £70k - £80k. He could bring a claim for wrongful dismissal in the employment tribunal, but you still don't recover your costs (normally). I do hope that there is negotiation taking place where JB agrees not bring any claim in return for the release of his registration. If so, it's likely that there would be a clause in any agreement that the club couldn't bring a claim against him either.
I'm no legal bod so this is probably bollocks, but I can't see how we could terminate the contract with Bullard and NOT give up his registration without us being left open to some punishment. If we want something from him in compensation, I reckon we'd have to go through the courts and prove our case, not blackmail him by preventing plying his trade.
