The section on the club's name, with a worked example relating to Manchester United, seems pretty clear. That said, people peddle half and half scarves and pin badges with the club name on outside the KCOM, so they presumably get away with it. I guess it would be different if they tried to sell it commercially online.
I love Obis passion, but honestly fella, this is what Lambo does so I'd find it hard to argue with him on this. He knows his onions on this subject does Lambo. I know!
It doesn't necessarily have to say Hull City. It could be an opportunity to take the piss out of him trying to drop the City part of our name. EccentriCity or SimpliCity Hull for example. http://www.morewords.com/contains/city/
The club are currently promoting this on Facebook and Twitter, presumably they've not noticed the name used... please log in to view this image
****ing hell, someone's head will be on a spike outside the Kcom when **** & ****er catch sight of that!
Flags with Hull City on would be great, but I remember a song about Hull City being booed not too long ago. Who's to say angry fans wouldn't see this in the same light and tear them apart in favour of the owners? Could happen.
Its done, I've designated Boxing Day Hull City day. The only thing missing is the people necessary to make it a reality. It will only be a success if people spread the message far and wide on Twitter, Facebook etc.
You know what I'm after. If you do this for a living then why don't you offer suggestions as how we can make this a reality rather than just saying no? It doesn't have to be done in public on this board. My reading of that advice is Hull City is not a trade mark and the use of the name may not be illegal, especially as the club don't use it. Yes I've seen the current advert but one swallow don't make a summer.
I don't think it's a practical proposition and I'm certainly not going to get involved in infringing anyone's trade mark registrations, so I've no interest in being involved.
Great stuff. Is there already a message we can share as a starting point? Feel free to message me privately if you prefer.
Thanks Happy. Passionate but not stupid, that's me. I'm planning on spending some of Christmas going through old case law. I've found a case which seems to be right up my street Arsenal FC v Matthew Reed (2002). Matthew lost but the reasons why are interesting. At first glance Matthew was found innocent of "passing off" and got done for using a trade mark name and the official badge, neither of which will be used for Hull City. https://en.wikipedia.org/wiki/Arsenal_Football_Club_vs._Matthew_Reed
The language being used is all wrong. 'Allam out' does not work. It's too direct and obvious. Easy to deflect. They don't care. How about; 'Allam can't afford to sell'. 'Allam isn't brave enough to sell'. 'Allam daren't speak to the fans'. 'Allams on the run'. 'Those who turn and run away, learn to live the Allam way'. 'Allams afraid of the minority'. I hear a lot about how they can't be stupid because they're rich but their business is supply and demand. That is not how you run a football club. We don't demand anything. We just want a club. Although I don't know why anyone's moaning, you'll get a free pie after all.
You're not going to tell me what the message is that needs spreading far and wide? I'm absolutely happy to help with this. Whatever it is we can splash it all over social media and promote it to a large proportion of fans pretty quickly. I need to know what the message is though.
You can read all the case law you like, it won't do you much good. The question is, if you get a Hight Court writ from Hull City Tigers Ltd, can you raise the £50k minimum it would cost you to challenge it, even if you do believe you have a case?
Different question to the first one you raised. I take things one step at a time. Is it a good idea? Yes. Is it legal? Probably but I'm not sure yet. Can we sell loads of stuff is the next question. Will we be sued and can we raise the money to defend the writ comes further down the list. One step at a time though is the order of the day.
